Amy Ratter
Amy Ratter was riding her Yamaha RD350 between Lerwick and Sumburgh. She was in
collision with a pedestrian who had emerged from an embankment onto the road. The pedestrian
collided with the left handlebar of Amy’s motorcycle. Amy sustained serious injury to her arm
affecting her ability to work.
The pedestrian sued Amy but Amy remained adamant that the accident had not been her
fault. Amy instructed Digby Brown to raise her own action. The case proceeded to a full
hearing in the Court of Session after the pedestrian had settled her own case out of Court.
Amy was accepted by the Judge as a credible and reliable witness not prone to
exaggeration. It was also accepted that the pedestrian had walked into the path of the
motorcycle ridden by Amy with no fault at all on the part of Amy. The award came to £184,728
which was met by the pedestrian’s household contents insurers.
