Birgitt Helwig

Birgitt was riding her Yamaha FZS600 Fazer motorcycle on the A915 Windygates Road in Fife. She had right of way at a junction.  As she proceeded through the junction a car driver failed to see her and emerged from her offside striking her motorcycle and throwing her into the air.  Birgitt was knocked unconscious and had very limited recollection of the accident circumstances.  A claim was intimated on her behalf.  The insurance company representing the interests of the negligent car driver denied liability.  Extensive investigations were carried out and thereafter the third party insurance company made an offer in the sum of £5,000.  Birgitt was advised to raise proceedings in the Court of Session and a jury trial was secured on her behalf.  The jury trial was set down for the 19th February 2008.  One week prior to the trial the defenders made an offer in the sum of £175,000.
It is often vital to proceed to litigation to secure a compensation award that adequately reflects the loss injury and damage sustained to the injured motorcyclist.
