Lee Hopkinson
Lee Hopkinson was riding his Z750 motorcycle northbound towards the Kincardine Bridge in
Scotland. Traffic both north and southbound was slow moving. Lee had been filtering
alongside the slow moving traffic. A 4 x 4 vehicle pulled out from a junction not realising
Lee was riding up the offside of northbound traffic. In order to avoid a collision Lee had no
option but to lay his motorcycle down. He slid along the road sustaining soft tissue
injury. Through his policy of legal expense insurance Lee was referred to a panel solicitor.
They made no contact with him other than to send a “claims pack”. Lee was told that liability
for the accident was denied. Lee was thereafter referred to a second firm of “panel
solicitors” through his legal expense insurance policy. On this occasion the panel solicitor
recommended that Lee accept that he was 80% to blame for the accident.
Lee contacted Andrew Campbell at Withy King Solicitors in England, through Motorcycle
News. Withy King referred the case to Digby Brown under the Cross Border Strategic Alliance
which exists between the two leading Motorcycle Accident law firms. Upon receipt of
papers Digby Brown contacted the independent witness who was entirely supportive of Lee’s
position. Neither of the previous “panel solicitors” had ever followed up lines of enquiry
with independent witnesses. Court proceedings were raised on behalf of Lee Hopkinson and
shortly before the case was set down for trial an offer was made on a full liability basis.
Lee recovered 100% of his damages. Lee had sustained soft tissue injury to the left elbow and
hip, right thumb and forefinger. His bruising and stiffness resolved within 2 weeks and the
pain in his finger was expected to resolve within 4 months. Lee’s case was settled for
£2,500.
