Hylton Hutchinson
Hylton Hutchinson was riding his Yamaha FZ1000 on the A713. The weather conditions were poor
and Hylton had adjusted his speed accordingly. Hylton was one of a group of 8 motorcyclsts from
Teeside headed off on their annual tour of Scotland.
As the group of riders approached a left hand bend, Hylton noticed the back of his friend’s
motorcycle quiver. Hylton recognised the distinctive rainbow colours of an extensive diesel spill
on the road surface. He had no time to react. The front of his bike slid away from him. He hit an
oncoming vehicle and was catapulted over his own machine sustaining injury.
Hylton didn’t realise he had a right to claim for his injuries. He instructed the Motorcycle
Law Department at Digby Brown. Diesel spills are caused by negligent drivers who frequently
overfill their tanks or fail to secure their fuel cap. Often the culprit is never traced. In those
circumstances a claim for compensation can be made to The Motor Insurers’ Bureau (MIB). Hylton was
advised to put an application in to the MIB under the “Untraced Drivers Scheme”. The diesel spill
had been extensive and a report had been made to the local police within 14 days.
The MIB accepted the claim and Hylton later settled for a sum of £7,000.
