Gordon Spiers
Gordon Spiers was riding his Honda VFR800I on the Fallin to Stirling Road. He lost control of
his motorcycle at a junction because there were two sunken manhole covers which the local council
had failed to inspect or repair. As his tyres lost traction on the manhole covers, the bike high
sided and he sustained multiple fracture injuries.
Mr Spiers was referred to a firm of solicitors through his Union. Over two years after the
accident, he was told his prospects of success against the council were limited and they were going
to close his file. However they did recommend that he seek a second opinion. Accordingly, Mr Spiers
contacted Digby Brown’s specialist Motor Cycle Law Department, with only three months to go before
his case timebarred. We accepted his case and carried out significant investigations into all
liability aspects of his case. Digby Brown instructed specialist reconstruction experts, and
obtained specialist orthopaedic and neurological reports. An action was raised in the Court of
Session, and the solicitors for the council maintained their denial of liability. After extensive
negotiations, Mr Spiers’ case settled on a full liability basis. He recovered 100% of his damages
against the Local Authority.
