Digby Brown Solicitors secures increase in damages to
£1.5million
Wednesday 7th April saw Digby Brown Solicitors secure an increase in damages from £500,000
to £1.5m, in Kirkaldy Sheriff Court, for a pedestrian involved in a road traffic accident.
Jennifer Blyth was eight years old when she was hit by a taxi while crossing the road in
Valley Gardens, Kirkcaldy on the 26th August 2000. She sustained serious head injuries including an
extensive skull fracture and severe brain injury.
The driver of the taxi Neil McGrory was convicted of driving without due care and attention
in June 2001.
Personal injury proceedings were initially raised in 2003 but the case was suspended until
specialist personal injury lawyers, Digby Brown LLP took over in early 2009. During this period
Digby Brown has had to investigate the circumstances of the accident, Jennifer’s injuries, and the
impact these injuries have had on Jennifer’s future wellbeing and ability to find work. To prepare
this case to a level where it is able to go to court given the time elapsed since the accident is
nothing short of remarkable.
Innes Laing, partner with Digby Brown LLP in Glenrothes asked the Court to increase the
sum sued for in damages from £500,000 to £1.5m and
with Sheriff Peter Braid ruling the case can now proceed to trial.
