Court award crash victim £3.3million in damages
Digby Brown Solicitors have helped Sean Milligan secure £3.3 million in damages due to a road
traffic accident in which he sustained serious injuries to his head and body. Sean was
involved in a head-on collison with Mark Lynch who was under the influence of alcohol and driving
on the wrong side of the road in a stolen van when the accident happened. He was later jailed for
nine months.
Although the other driver was uninsured Digby Brown were able to make a claim to the Motor
Insurers Bureau. This is an organisation funded by UK insurance companies to provide compensation
to victims of uninsured or untraced motorists.
Sean's sister Elizabeth Gordon, who has been at his side throughout the case, said: “It has
been a long and harrowing five years for Sean and the family. We are delighted at the outcome and
very relieved that this matter is at a conclusion.”
Robert Swanney of Digby Brown, who acted for Sean, said: “This case hinged on whether someone
who requires 24 hour 7 days a week care should have a right to the best possible care regime or, as
the defenders argued, the cheapest - in Sean's case this is whether they could employ a care agency
or for Elizabeth, his sister, to have to employ carers directly. I am delighted the court
ruled very much in favour of Sean’s interest.”
