In order to succeed in a personal injury claim, it is usually necessary to show that the accident was caused by someone else’s negligence. The law of negligence has been built up over many years through reported court cases. As a result the law lays down 'standards of care' which apply to all the fields of human activity. If we can show that someone has failed to meet the required standard of care, and you have suffered injury as a result, they will be found to have been negligent and you will have a legal right to make a claim for damages against them.  In practice, virtually all claims are handled not by the negligent parties, but by their insurers.

In relation to accidents at work, statutes and regulations play an ever-increasing role. Work activities are now governed by a package of regulations which implement Directives of the European Parliament. It is difficult for solicitors who do not have in-depth knowledge of these regulations to properly advise in work related claims. Often, statutory cases will allow a claim to succeed in circumstances where it might not be possible to establish negligence.  For example, where an employer is strictly liable for any defect in work equipment, regardless of whether he knew the defect existed.

It is not just other motorists and employers who can be found to have been negligent. It is possible to bring a claim against anyone who, through negligence, has caused you injury. For example, a local authority in relation to paving defects or the occupier of unsafe premises.
