Digby Brown is ranked in Band 1 in Chambers Guide to the UK Legal Profession in both 2006 and
2007. This means that other lawyers rate Digby Brown as one of the best personal injury firms
in Scotland. We deal with all types of personal injury claims. However, they fall into the
following broad categories:-
Road Traffic Accidents
If you have been injured as a result of another road user’s negligence, we can help you to
obtain compensation for your injuries and financial losses. We have particular expertise in
handling brain and spinal injury cases, many of them caused by road accidents. Each year we
take on, and win, cases which other solicitors have turned down. Whatever the circumstances
of your road accident, our specialist solicitors are here to help you.
Everyone driving a vehicle on the road should have insurance, but in fact something like one
in twenty drivers does not. To make matters worse, these drivers are responsible for a
disproportionate number of accidents. In cases where the negligent driver is uninsured or
untraced, the Motor Insurers’ Bureau will take the place of the insurer to protect the rights of
innocent victims. We can assist in relation to all aspects of Motor Insurers’ Bureau
claims.
Accidents at Work
Whether you work in an office, a shop or in industry, workplace accidents are all too common.
Employers have a duty to ensure that places and systems of work are kept safe. Various statutes and
regulations exist to protect employees at work and if it can be shown that these have not been
complied with, and that this failure has caused personal injury, you can pursue a claim for
compensation.
General Accident
In addition to the more obvious road traffic and industrial accidents, we also act for
clients who have been injured in other ways, for example through defective roads or
pavements. If we can show that the defect has been present for a minimum period of time or
that the local authority has failed to respond to a complaint, it may be possible to recover
damages. Similarly, if you have been injured by someone else’s negligence, it may be possible
to make a claim against that person’s home insurance policy.
Industrial Diseases
Throughout the second half of the twentieth century thousands of Scots working in heavy
industry and construction were exposed to asbestos. The effects of that exposure take many
years to develop and we are only now seeing the results of exposure which happened upwards of forty
years ago. At Digby Brown we have solicitors with many years' experience of handling
asbestos-related claims.
Our specialist Industrial Disease Department can also help you recover compensation for a
variety of work-related conditions including Occupational Asthma, Vibration White Finger and
Occupational Dermatitis.
Medical Negligence
Victims of medical accidents need specialist legal advice in what is a highly complex area of
law. Digby Brown has joined forces with an English firm of medical negligence specialists, Osborne
Morris & Morgan to form Digby Brown Osborne Morris & Morgan, a specialist Division of Digby
Brown. Digby Brown Osborne Morris & Morgan has particular expertise in cerebral palsy
cases. If you or a relative have sustained serious injury through a medical accident, Digby Brown
Osborne Morris & Morgan can bring vast experience and specialist knowledge to the investigation
and handling of your claim.
Criminal Injuries Compensation
Victims of violent crime can suffer devastating physical and psychological injuries. Our
experience and expertise in acting for victims of criminal assaults allows us to assess the
prospects of success. We can make an application on your behalf to the Criminal Injuries
Compensation Authority and represent you throughout the process.
Product Liability
If you have been injured by a defective product or by a product which carried insufficient
safety instructions, you may be able to recover compensation from the manufacturer or supplier
under the Consumer Protection Act 1987.
Accidents Abroad
Few people setting off on holiday like to think that their time away will be ruined by an
accident, but each year Scottish holidaymakers are involved in accidents abroad. Road accidents and
accidents in hotels and swimming pools do happen. An outbreak of food poisoning can turn a
holiday or cruise into an ordeal.
