First Wave

These majority of these claims are presently sisted (frozen) until the Supreme Court has dealt with this issue in another group of cases.  That case will be heard by the Supreme Court during May 2013 and the Judgment is expected thereafter.

Second Wave

A process of exchange of information relating to comparator roles is ongoing. The Tribunal have fixed a procedural Case Management Discussion (CMD) for 28 March 2013 to allow the Council further time to set out their 'material factor' defence.   The CMD which will consider the issues and preparation required for a future hearing which the Tribunal seek to hold towards the end of 2013.
