Future wage loss must be considered when considering due compensation for driver after injury in road traffic accident in Girvan
A lady driver, Mrs A. in her late 50's was driving along the Girvan to Newton Stewart Road. Her 2 year old grandson was a back seat passenger. A young male driver was approaching from the other side of the carriageway. He attempted to overtake a lorry and hit our client head on. She suffered a fractured sternum, broken ribs, and ankle. Her grandson suffered a leg fracture which luckily mended well.
Fault of the accident was not disputed however the level of compensation due to the client was. As Mrs A was approaching 60 and there was an entry in her GP records saying that she probably would work for a year after her 60th birthday, the level of her future wage loss was disputed. We managed to get supportive statements from her work colleagues and settled her claim for double the original offer from the third party insurers. We settled her claim at £100,000.
