Loss of earnings critical to assessing level of fair compensation
Mr C.'s vehicle was struck from behind by another vehicle in Fort William. The client struck his arm in the accident and developed tennis elbow. This resulted in the client being unable to work for over 2 months and he lost out of £3,500 earnings. A court action was raised and the Defenders offered £6,500 which was rejected. After robust negotiations and rejecting a further offer of £8,700, Mr C.'s claim settled for £10,000 inclusive of his wage loss.
