School pupil sustained brain injury after being run down by speeding motorist

Digby Brown was instructed to act as correspondents for Moffat & Co, Solicitors for a school pupil who was injured when she was walking across a pedestrian crossing in Prestonpans. She was crossing the road with a friend in a southerly direction. As she was crossing the westbound carriageway, she was struck by a motor vehicle travelling in a westerly direciton at a speed of 54 mph. The speed limit was 30 mph. Cause of the accident was denied by the motorist’s insurance company.

Our client sustained a severe traumatic brain injury as a result of the accident and she may struggle to find gainful employment in the future. The insurance company made a pre-litigation offer of £350,000. The offer was rejected and we instituted proceedings. Following extensive investigations into the injuries sustained by the pursuer, the case settled for £1,000,000,
