Our client in this case was a man injured in a car accident in a supermarket car park in Dumfries. 

How did the car accident happen?

He was stationary in the car park when another driver reversed out of his parking space and hit his car. 

Our client was with his partner and son  at the time.

Another independent person also witnessed the accident. The other driver tried to drive away from the scene and was only stopped by our client’s partner who pursuer him through the car park on foot.

Road traffic personal injury compensation claim

The driver at fault maintained throughout the case that this road traffic personal injury compensation claim should be settled on a 50/50 basis as both were at fault.  He said both vehicles were reversing at the same time and struck each other. 

Digby Brown thoroughly investigated the accident circumstances and considered all of the evidence in great detail. 

In our mind there was no doubt that the other driver was fully to blame for the accident and all of the evidence backed this up. The only person maintaining otherwise was the other driver.

Raised the car accident claim in court

In the absence of a complete admission of liability, Digby Brown were instructed to sue the other driver in court. 

Even after the court procedure started, the other driver still denied the accident was wholly his fault. He offered again to settle the claim on a 50/50 basis. 

The other driver's insurers and solicitors had plenty of time to speak with the independent witness but still refused to move from the 50/50 settlement offer.

Our client received around £2,000 for his injuries and on top of this the costs of private physiotherapy treatment he had required after the accident were met by the other driver's insurers.
