The individual died when driving a vehicle in the course of his work in the Highlands. The case highlights the importance of workplace health and safety, the need for employers to meet their legal obligations to provide a secure working environment, safe equipment and carry out robust risk assessments ahead of very job which could pose danger to the person carrying it out.
Digby Brown are pursuing this accident at work case from our Highlands office in Inverness, on the basis that the defenders breached before their Common law duties of care towards their employee and the Management of Health & Safety at Work Regulations 1999, Provision and Use of Work Equipment Regulations 1998 and Occupiers Liability (Scotland) Act 1960 relating to the defenders health and safety failures. This case is an example of the range of family members who may be entitled to fair and appropriate compensation under Scottish law if an individual dies as a result of a workplace accident that wasn’t their fault.
