Fallen wood from window leaves permanent scarring

Digby Brown Inverness office acted for Mrs. P who was injured walking through the street in the centre of Inverness.

She was walking between shops, minding her own business, when suddenly she was struck by a piece of wood which had fallen out of a window where building work was taking place.

Mrs. P fell to the ground and suffered a deep cut to her forehead which covered her face in blood. She was immediately assisted by passers-by and local shopkeepers, who called for an ambulance.

The incident was also reported to the builders. Mrs. P needed some time off work, and she was left with a single noticeable scar to her forehead, which caused her some embarrassment.

Although she knew little about where the piece of wood came from, and the circumstances in which it fell, she wondered whether this would be a situation where she could gain compensation from the building company.

She spoke to Digby Brown Inverness about the incident, and they reassured her that they would be able to help her gain compensation.

Associate Solicitor Sam Cowie in our Inverness office was able to help by identifying who was responsible and explaining to them why according to the law of Scotland, they would be liable for this incident.

He then presented a valuation to the building company’s Insurer, and the case eventually settled with an award to Mrs. P of £15,500.
