How does Compensate funding work?

Compensate is the trading name of Compensation Claims Funding Limited, a limited company wholly owned by Digby Brown Solicitors. The Compensate scheme gives clients complete protection against liability to pay the other side’s legal expenses should they lose their case. It also provides a complete funding package to pay all outlays.

Why solicitors use Compensate funding  

It allows all cases to be ran on a profitable basis for both the referring firm and their client. Without a funding package such as Compensate, most lawyers have to do speculative work without the support of insurance against expenses.

This makes litigating very difficult and risky. The temptation to settle without raising proceedings can therefore be overwhelming for the client. However settlements pre litigation tend to be significantly lower.  

The Compensate funding process  

The process of applying for Compensate funding is very straightforward with all administration being taken care of directly. 

If Digby Brown consider that the client’s claim has a reasonable prospect of success, their case will be referred to Compensate which will carry out a separate assessment of the case. If Digby Brown do not consider there is a reasonable chance of success the referring Solicitor will receive a note from an accredited expert, free of charge.

Compensate will enter into a contract with the client. That contract will provide that, in exchange for a percentage of their damages, payable at the end of the case, Compensate will fund their case throughout and will give them complete protection in relation to the expenses of the court action. Compensate will take out, at its expense, an insurance policy to give the client guaranteed peace of mind.
