How did the motorcycle accident happen?

Our client was riding his motorcycle when a parked commercial van failed to see him and pulled out of his parking space - directly into our client's path.

Our client and his bike were thrown across the road, into the path of an oncoming Audi A3, where there was a head on collision.

The driver of the van was later charged with careless driving, and was found to have been driving without a wing mirror.  The van driver’s view of vehicles approaching from the rear, such as our client’s motorcycle, was heavily restricted.

The insurers made a cynical and unsolicited offer of £7,000 to compensate our client for his motorcycle injuries and all other past and future financial losses. This offer was made before all of the evidence was in place. 

There was no attempt by the insurer to obtain the medical evidence needed to properly assess and understand our client's injuries or the impact they would have on the rest of his life.

Our solicitors in Dundee proceeded in gathering further medical evidence and other reports from a specialist Consultant Orthopaedic and Trauma Surgeon, a Consultant Psychologist, a Vocational Consultant (Employment expert), and a Consulting Actuary (for a Pension Loss Report).

Consideration had to be given to the client's future ability to work, and which type of occupation he might be able to work in, and the impact on his future earnings and pension as a result of his motorcycle accident injuries.
