How do I make a claim?

To start the process of making a claim, simply get in touch with us, either by filling in our enquiry form or by calling 0333 200 9525 (local rate, including from mobiles).   If you make an enquiry via our online form, we will get in touch with you to have an initial discussion or to arrange a convenient time for us to do so.

What are the first steps involved in making a claim?

However you get in touch with us, the first thing we will do is listen to you to find out simply what happened and find out the extent of your injuries, before discussing how we can help.  

Wherever possible we like to follow up the initial conversation by arranging a face to face meeting with new clients. This gives you the opportunity to meet the person who will be handling the case and it allows us to take a detailed statement about the accident and your injuries.  If your injuries prevent you attending one of our offices, we will be happy to visit you at your home or in hospital.

How will my case be funded and will I have to pay anything?

During our initial discussion, we will fully explain how we fund the case. Digby Brown operates a funding scheme, Compensate, which ensures all costs in the legal process are met by us throughout the case.

In most circumstances, we will, when your case is successful, take as our fee, a percentage of your damages; this can be between 10-20%.  If the case is not successful you won’t ever pay us a penny.  We believe that this is the fairest method of giving clients access to justice whilst ensuring their cases are fully investigated, prepared and funded.

Our experience and statistics show time and time again we will achieve the fair level of compensation, which will be substantially more than the insurer is initially prepared to offer.

Explaining the accident claims process

Following our initial meeting we will submit a claim on your behalf by writing to the person responsible for the accident telling them why we believe they are liable to pay you compensation. We understand that an accident caused by the negligence of your employer or someone who is familiar to you can be a difficult situation – however, in almost all cases we will be dealing not with the person who caused the accident but with their insurers.  

We will need to obtain a medical report so that we assess the level of compensation you are entitled to.
