Helping a family after tragic road collision

Innes Laing, Partner in Digby Brown’s Kirkcaldy office, helped a family secure justice in the civil courts after prosecutors ruled out criminal charges following a fatal road collision.

Robbie Rintoul, aged 68, died after he was struck by an HGV at an industrial site in Thornton, Fife after the driver failed to spot him before moving off.

Following an investigation by Police Scotland the Crown Office and Procurator Fiscal Service concluded no action would be taken against the driver.

However the family sought the help of Digby Brown and our solicitors in Kirkcaldy investigated a civil action against Strathore Plant Hire Ltd on the grounds that Robbie’s death was the result of driver negligence.

The case for compensation settled in February 2018 before it reached court – saving Robbie’s family the upset of going through a formal court process.

The families’ battle for justice generated national media interest on Tuesday 13 March – which can be read online at The Courier and The Herald.

Innes Laing, Digby Brown Partner, said: “This was a tragic incident for the family to endure.

“They have shown great strength of character in dealing with the defenders and hopefully they will now be able to restore some sense of balance and peace to their lives.”
